1. Agreement to Terms

By accessing or using Summit (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Summit is operated by "Summit" ("we," "us," or "our").

2. Description of Service

Summit is an audio-first content consumption platform that:

  • Extracts content from web URLs you provide
  • Generates AI-powered summaries
  • Converts text to audio for listening
  • Provides content organization and management tools

The Service includes:

  • Mobile applications (Android)
  • Browser extensions (Chrome, Firefox)
  • Web interface at summarize-it.app
  • Associated APIs and services

3. User Accounts

3.1 Registration

  • You must create an account to use certain features
  • You must provide accurate, current information
  • You are responsible for maintaining account security
  • You must be at least 13 years old (or age of digital consent in your country)

3.2 Account Security

  • Keep your password secure
  • Notify us immediately of unauthorized access
  • You are responsible for all activity under your account
  • We are not liable for losses from unauthorized use

4. Subscription and Payment Terms

4.1 Free Tier

  • Limited features as described on our website
  • Trial period with 50 credits for new users
  • Subject to usage limits

4.2 Paid Subscriptions

  • Pro Tier: $5.99/month (250 credits)
  • Premium Tier: $11.99/month (500 credits)
  • Annual subscriptions available with ~17% discount
  • Prices subject to change with 30-day notice

4.3 Billing

  • Subscriptions auto-renew unless cancelled
  • Charged at start of each billing period
  • Payment via Google Play or Stripe
  • Prices in USD unless otherwise stated

4.4 Cancellation

  • Cancel anytime through account settings or Google Play
  • Cancellation takes effect at end of current billing period
  • Access continues until period end
  • No partial refunds for mid-period cancellations

5. Use of Service

5.1 Acceptable Use

You agree to:

  • Use the Service only for lawful purposes
  • Provide URLs you have legal right to access
  • Not abuse, harass, or harm other users
  • Not circumvent usage limits or security measures
  • Not use the Service for commercial scraping or data harvesting

5.2 Prohibited Uses

You may NOT:

  • Share accounts with multiple users
  • Resell or redistribute Service features
  • Reverse engineer, decompile, or hack the Service
  • Use the Service to infringe copyrights or other IP rights
  • Submit malicious content (malware, viruses, spam)
  • Use automated systems to access the Service without permission
  • Impersonate others or misrepresent affiliation

Violation may result in immediate account termination without refund.

6. Content and Intellectual Property

6.1 Your Content

When you submit URLs or content:

  • You retain ownership of content you submit
  • You grant us a license to process, summarize, and convert your content to audio for Service delivery
  • You represent that you have rights to submit the content
  • You are responsible for ensuring content submission is legal

This license ends when you delete content from the Service.

6.2 User-Initiated Content Saving

Summit is a "read it later" service, similar to Pocket or Instapaper. When you share an article with Summit, you direct us to:

  • Fetch content from a URL you have access to and are actively viewing
  • Save it to your private queue for your personal, non-commercial consumption
  • Generate audio and summaries for accessibility and convenience
  • Store it in your account (not publicly redistributed)

What We Do NOT Do:

  • We do not crawl or bulk-scrape websites
  • We do not bypass paywalls or access restrictions
  • We do not publicly redistribute content
  • We do not use content for any purpose other than your personal consumption

6.3 AI-Generated Content

  • Summaries are generated using AI (Google Gemini, OpenAI)
  • AI-generated summaries may contain errors or inaccuracies
  • Summaries are provided "as is" without warranty
  • You are responsible for verifying important information
  • We are not liable for decisions made based on AI summaries

6.4 Our Intellectual Property

  • The Service, design, code, and features are our property
  • "Summit" name and logo are our trademarks
  • You may not use our IP without written permission

7. Third-Party Services

The Service integrates with:

  • Google Gemini (AI summarization)
  • OpenAI (AI summarization, text-to-speech)
  • Lemonfox (text-to-speech)
  • Jina Reader (content extraction)
  • Supabase (infrastructure)
  • RevenueCat (subscription billing)

These services have their own terms. We are not responsible for third-party services.

8. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms.

Key points:

  • We collect minimal personal data
  • Your content is processed for service delivery
  • We use cookies and analytics
  • GDPR and CCPA rights apply

9. Disclaimers and Limitation of Liability

9.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free from viruses or harmful components
  • AI summaries are accurate or complete
  • Audio quality meets your expectations

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR any indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, or use, or cost of substitute services.

OUR TOTAL LIABILITY IS LIMITED TO: The amount you paid us in the 12 months before the claim, or $100, whichever is greater.

10. DMCA and Copyright Policy

We respect intellectual property rights. If you believe content in the Service infringes your copyright:

Send written notice to: support@summarize-it.app

Include:

  • Your contact information
  • Description of copyrighted work
  • URL or location of infringing content in our Service
  • Statement of good faith belief
  • Statement that information is accurate
  • Your physical or electronic signature

We will respond to valid DMCA notices per 17 U.S.C. ยง 512. We will terminate accounts of repeat copyright infringers.

11. Modifications to Terms

  • We may modify these Terms at any time
  • Changes effective 30 days after posting
  • Continued use constitutes acceptance
  • Material changes will be notified via email
  • If you disagree, stop using the Service and cancel

12. Termination

By You

  • Cancel subscription anytime
  • Delete account in settings
  • Data deleted per Privacy Policy

By Us

  • We may suspend or terminate for Terms violations
  • We may discontinue Service with 30-day notice
  • No refund for termination due to violations
  • Pro-rated refund for Service discontinuation

13. Dispute Resolution

Informal Resolution

Before filing a claim, contact us at support@summarize-it.app to resolve informally. We'll attempt resolution within 60 days.

Arbitration

If informal resolution fails, disputes will be resolved by binding arbitration on an individual basis (no class actions), conducted in accordance with Israeli arbitration law.

Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles.

14. General Provisions

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us.
  • Waiver: Failure to enforce any provision does not waive our right to enforce it later.
  • Severability: If any provision is unenforceable, remaining provisions remain in effect.
  • Assignment: We may assign these Terms. You may not assign without our consent.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control.
